This Public Offer (the “Offer”) constitutes an official proposal by the MaskNet service (the “Provider”) to any legally capable person (the “User”) to enter into an agreement for the provision of services on the terms set out in this Offer.
The User’s performance of actions involving registration, payment for a Tariff, activation of a subscription, receipt of a configuration, connection to the Service or actual use of the Service constitutes full and unconditional acceptance of this Offer.
1. Terms and Definitions
1.1. Service means the combination of software, technical and informational resources of MaskNet, including the website, personal account, Telegram bot, configurations, instructions, software interfaces and other materials made available by the Provider.
1.2. User means an individual using the Service under the terms of this Offer.
1.3. Services means providing the User with remote access to the functionality of the Service, configurations, the Provider’s digital infrastructure and related technical capabilities within the selected Tariff.
1.4. Tariff means the terms for provision of the Services, including duration, price, set of functions, limitations relating to devices, locations, traffic volume and other parameters published in the Service.
1.5. Subscription means a paid period of access to the Service under the terms of the selected Tariff.
1.6. Personal Account means a section of the Service through which the User receives information about the subscription, configurations, access parameters and other functions of the Service.
1.7. Telegram Bot means a software interface within the Telegram messenger used by the Provider for automated interaction with the User.
1.8. Configuration means technical data, keys, links, files and other parameters required to use the Service.
1.9. Support means a communication channel between the User and the Provider for matters relating to payment, access, setup and use of the Service.
2. General Provisions
2.1. This Offer constitutes a public offer in accordance with paragraph 2 of Article 437 of the Civil Code of the Russian Federation.
2.2. The agreement between the Provider and the User is deemed concluded from the moment the User accepts the Offer.
2.3. The User confirms that prior to accepting the Offer, the User has reviewed its terms, the Tariff terms, the Service Rules, Data Processing Policy and Refund Policy published in the Service.
2.4. The Services are provided remotely through the Internet using the Provider’s technical resources and/or third parties engaged by the Provider.
2.5. The Provider may, at its discretion, change the composition, interface, list of functions, available locations, authentication methods and other parameters of the Service without reducing the scope of Services already paid for by the User, except where such changes are caused by legal requirements, actions of third parties, infrastructure limitations, security measures or force majeure circumstances.
3. Subject Matter of the Agreement
3.1. The Provider undertakes to provide the User with access to the Service under the terms of the selected and paid Tariff, and the User undertakes to pay for such Services and comply with the terms of this Offer.
3.2. The specific terms for provision of the Services are determined by the Tariff description in effect at the time of payment.
3.3. The Services are provided exclusively for personal use unless otherwise expressly provided for by the relevant Tariff or separate terms of the Provider.
4. Cost of Services and Payment Procedure
4.1. The cost of the Services is determined by the Tariffs published in the Service at the time the order is placed.
4.2. Payment is made by cashless payment using the payment methods available in the Service.
4.3. The User’s payment obligation is deemed fulfilled from the moment successful payment is confirmed by the payment partner or funds are otherwise confirmed as credited.
4.4. The Provider may unilaterally change the cost of Tariffs. The new cost applies only to new payments, renewals and new Subscriptions.
4.5. If the User is provided with a discount, bonus, promo code, special price or additional access days, these apply only within the relevant offer and do not create an obligation for the Provider to preserve such terms in the future.
5. Rights and Obligations of the Provider
5.1. The Provider undertakes to:
5.1.1. Provide access to the Service after payment is confirmed.
5.1.2. Maintain operation of the Service within available technical capabilities.
5.1.3. Publish current Tariffs and terms of use in the Service.
5.1.4. Review User requests submitted through Support.
5.1.5. Take reasonable measures to protect technical information used in operation of the Service.
5.2. The Provider may:
5.2.1. Change Tariffs, architecture, interface, access methods and other parameters of the Service.
5.2.2. Restrict, suspend or terminate the User’s access to the Service in the event of a violation of this Offer, the Service Rules or law, or upon detection of suspicious activity.
5.2.3. Establish restrictions on the number of devices, traffic volume, number of simultaneous connections, available locations and other parameters depending on the Tariff.
5.2.4. Engage third parties to perform its obligations.
5.2.5. Carry out technical work, updates and maintenance.
6. Rights and Obligations of the User
6.1. The User undertakes to:
6.1.1. Pay for the Services in a timely manner.
6.1.2. Independently ensure compatibility of their devices, applications and network environment with the Service.
6.1.3. Not transfer access to the personal account, configurations, subscription QR codes or other access data to third parties without the Provider’s consent.
6.1.4. Not use the Service for unlawful purposes.
6.1.5. Not use the Service for sending spam, phishing, malicious automation, network attacks, distribution of malware, fraud, unauthorised access or other abuse.
6.1.6. Not take actions that create excessive or abnormal load on the Service infrastructure.
6.1.7. Not exploit vulnerabilities of the Service for the purpose of obtaining benefit or causing harm.
6.1.8. Comply with the laws of the country in which the User is located and the country in which the infrastructure being used is located.
6.2. The User may:
6.2.1. Use the Service during the paid period within the limits of the selected Tariff.
6.2.2. Contact Support regarding access, payment and basic setup.
6.2.3. Request a refund in the cases and according to the procedure provided for by the Refund Policy.
7. Limitations and Liability
7.1. The Service is provided on an “as is” and “as available” basis.
7.2. The Provider does not guarantee:
7.2.1. Uninterrupted and error-free operation of the Service at all times.
7.2.2. Availability of specific websites, applications, platforms, games, banking services or other third-party resources.
7.2.3. Permanence of IP addresses, their reputation, fraud score, absence of CAPTCHA, absence of blocking or other restrictions imposed by third parties.
7.2.4. Achievement by the User of any specific connection speed.
7.2.5. Operation of the Service in every country, region or network, with every Internet service provider or on every device.
7.3. The Provider is not liable for:
7.3.1. Interruptions, restrictions, blocking and other consequences caused by Internet service providers, data centres, platform owners, telecommunications operators, government authorities or other third parties.
7.3.2. Inability to use the Service for reasons relating to the User’s device, software, network settings, DNS, proxy, client, router or other user environment.
7.3.3. Damage resulting from unlawful, negligent or otherwise non-compliant use of the Service by the User in breach of this Offer.
7.3.4. Actions performed by the User using the User’s account, configurations, keys or devices.
7.4. If the User violates the terms of this Offer, the Provider may restrict access to the Service in whole or in part without prior notice.
8. Confidentiality and Technical Information
8.1. Only the minimum amount of technical information necessary to identify the User within the Service, manage the subscription and ensure operation of the Service functions is used as part of operation of the Service.
8.2. Such information includes the Telegram ID and technical subscription statuses, including validity period, Tariff parameters, information on the issued configuration and other similar technical data.
8.3. The Service does not request or process the User’s payment details. Payment processing is performed by payment partners.
8.4. The Provider takes reasonable measures to protect the technical information used against unlawful access and other unlawful actions.
9. Term, Amendment and Termination
9.1. This Offer enters into force from the moment it is published in the Service and remains in force indefinitely until withdrawn or replaced by a new version.
9.2. The Provider may amend the Offer unilaterally. A new version enters into force from the moment it is published in the Service unless another effective date is stated separately.
9.3. Continued use of the Service after publication of a new version of the Offer constitutes the User’s acceptance of its terms.
9.4. The User may discontinue use of the Service at any time. In this case, paid access remains available until the end of the paid period unless access is restricted on the grounds provided for by this Offer.
9.5. The Provider may terminate provision of the Services to the User if the User violates the law, the terms of the Offer, the Service Rules or the Refund Policy.
9.6. Refunds are governed by a separate Refund Policy.
10. Force Majeure
10.1. The Parties are released from liability for full or partial non-performance of their obligations upon the occurrence of force majeure circumstances, including but not limited to communication failures, accidents, fires, floods, large-scale cyber incidents, actions of government authorities, military actions, blocking, epidemics, sanctions, power outages and other extraordinary circumstances.
11. Final Provisions
11.1. The laws of the Russian Federation apply to relations between the Parties.
11.2. The Parties seek to resolve all disputes and disagreements through negotiations and a pre-trial request submitted through Support.
11.3. If a dispute is not resolved through the pre-trial procedure, it shall be considered in accordance with the applicable laws of the Russian Federation.
11.4. Invalidity of one provision of the Offer does not result in invalidity of the remaining provisions.
11.5. The current version of the Offer is published in the Service.
